Global Travel Rights Benefits Terms for Autodesk Maintenance Plans, Subscription for single-user and Subscription for multi-user

 

The following Benefits Terms shall additionally govern Your Global Travel Rights Benefits for Your Maintenance Plan and/or Your Subscription for single-user and/or Your Subscription for multi-user, as applicable.

1. DEFINITIONS

The following terms shall have the meanings set forth below. Capitalized terms used and not otherwise defined in these Benefits Terms shall have the meaning assigned to them in Your Maintenance Plan Agreement, or Subscription Agreement for single-user or Subscription Agreement for multi-user (as applicable).

“Ancillary Product”: means any product or software (other than an Eligible Version of Covered Software or any Ancillary Services or Support) which Autodesk may furnish to You from time to time as a Benefit of Your Maintenance Plan or Subscription for single-user or Subscription for multi-user (as applicable) and which is further described at Autodesk Account. Ancillary Products may include, but are not limited to, tools and other discreet products that require a separate Installation and function independently of an Eligible Version of Covered Software. 

“Ancillary Services”: any services, including but not limited to Web Services, (other than a version of Covered Software or any Ancillary Products or Support) which Autodesk may make available to You from time to time as a Benefit of Your Maintenance Plan, or Subscription for single-user or Subscription for multi-user (as applicable) and which (where applicable) are further described at Autodesk Account.

“Eligible Versions of Covered Software” means the latest version of Covered Software Installed and Accessed by You and any previous versions of Covered Software (“Previous Versions”) for which You have been granted Previous Version Rights Benefits pursuant to Your Maintenance Plan Agreement, or Your Subscription Agreement for single-user or Your Subscription Agreement for multi-user (as applicable).

 “Home Country” means the country or jurisdiction which (i) if You are an individual, is Your principal place of residence or, (ii) if You are a company or other entity, is the country of incorporation for Your entity. If Your Home Country is a member country of the European Union or the European Free Trade Association, then for the purposes of Your Subscription Agreement for single-user all/any of the countries of the European Union and the European Free Trade Association shall be considered Your Home Country.

“Support”: means the program offered generally by Autodesk under which Autodesk may provide (among other things) technical support services as a Benefit of Your Maintenance Plan, or Subscription for single-user or Subscription for multi-user (as applicable) and which is further described at Autodesk Account.

"Web Services" means web- or cloud-based services requiring a connection to the Internet, and services or functionality that are hosted or otherwise made available, on servers owned or operated by or for Autodesk or its designee, or by separate entities not related to Autodesk.

2.  GLOBAL TRAVEL RIGHTS BENEFITS

2.1  Notwithstanding anything to the contrary contained in the applicable Autodesk License and Services Agreement with respect to Territory, during the Term of Your Maintenance Plan or Subscription Agreement for single-user or Subscription Agreement for multi-user (as applicable) and subject to the requirements set forth in these additional Benefits Terms, for all Maintenance Plans and/or Subscriptions for single-user and/or Subscriptions for multi-user legally purchased and acquired in your Home Country, You may Install, or permit Your employees or Named Users (as applicable) to Install, applicable Eligible Versions of Covered Software and/or any applicable Ancillary Products on a portable Computer and Access those Eligible Versions of Covered Software and/or Ancillary Products outside the Territory without Autodesk’s written consent. Applicable Eligible Versions of Covered Software and/or any applicable Ancillary Products may only be used in accordance with the other provisions of Your Maintenance Plan and/or Subscription Agreement for single-user and/or Suscription Agreement for multi-user and solely for Your own internal business needs as provided in the applicable Autodesk License and Services Agreement. Global Travel Rights Benefits may not be available for all Eligible Versions of Covered Software and/or Ancilliary Products or in all countries.

2.2  Your Global Travel Rights Benefits are subject to all of the following:

2.2.1  except as otherwise provided in these Benefits Terms, Installation and Access of all/any applicable Eligible Versions of Covered Software and/or applicable Ancillary Products shall be governed by the applicable Autodesk License and Services Agreement (including, but not limited to all U.S. or other applicable export control laws), any applicable Previous Versions Benefits Terms and/or any applicable Ancillary Products Benefits Terms;

2.2.2  In the case of Maintenance Plans and Subscription for multi-user, Installation and Access of all/any applicable Eligible Versions of Covered Software and/or applicable Ancillary Products is solely on a portable Computer that will travel with You or Your employees while outside the Territory

2.2.3  In the case of Maintenance Plans and Subscription for multi-user, all/any applicable Eligible Versions of Covered Software and/or applicable Ancillary Products may not be copied or transferred to any other Computer or Accessed by anyone other than You or Your employees while outside the Territory;

2.2.4  Applicable Eligible Versions of Covered Software and/or Ancillary Products may not be Accessed by anyone other than the particular licensed User or Named User while outside the Territory; and

2.2.5  if You are entitled to Support Benefits the Available Support Hours (as defined in the Support Benefits Terms applicable to Your Maintenance Plan and/or Subscription Agreement for single-user and/or Subscription Agreement for multi-user) for Your Territory apply.
